Terms of Use

In these terms, "we", "us" and "our" mean Cadentic, Inc., the company that runs Albie. "You" means the person who creates or uses an account.

We keep a record of when you agreed to these terms. If you do not agree to them, please do not use Albie.

A school uses Albie under a separate agreement with us, together with these terms.

At launch, Albie is offered in the United States only.

• You must be 18 or older to open a family account or a school account.
• A student who is 13 or older may create their own account. A student under 18 needs the permission of a parent or guardian.
• A plan must be bought by an adult. If you are under 18, a parent or guardian must enter the card and agree to the charges.
• A child under 13 may use Albie only through a parent or guardian, or through their school.

Your account

• Keep your sign-in details safe.
• An account is for its own learners only: the children in your family, or the students at your school.
• If you think someone else has used your account, write to support@cadentic.ai.

Albie is paid for with a plan. Each learner on a plan takes one seat.

The Family plan

• $32 per learner per month
• $320 per learner per year (2 months free)

A founding price of $264 per learner per year is offered to those who start a plan during Albie's launch month. It starts with the same free trial. You keep the founding price for as long as you stay subscribed.

A plan at $5 per learner per month is offered to families who bring their own Anthropic API key. On it, Albie's lessons run on your key: Anthropic bills you directly, at its own prices, for what Albie uses, and that use is not part of our plan's usage caps. You are responsible for the key and for your Anthropic account, including its terms, limits and credit; Albie cannot teach while no working key is in. We store the key encrypted, use it only for your learners' lessons, and delete it when you remove it or delete your account. The same free trial and monthly usage apply.

The School plan

The School plan costs $179 per student per year. We set up each school ourselves, by agreement with the school.

Changing your plan

Adding seats, or moving to a higher price, is charged that day for the rest of the billing period. Fewer seats, or a move to a lower price or a shorter period (such as yearly to monthly), takes effect at the end of the period you have paid for.

Taxes and price changes

Taxes may be added where the law requires them.

Prices can change, but never in the middle of a period you have paid for. We will email you about a new price at least 14 days, and not more than 30 days, before the renewal it starts with, and tell you how to cancel. If you cancel within 14 days after the first charge at a new price, we refund the unused part of that period.

The Family plan's monthly and yearly prices start with a 7-day free trial, and so does the founding price.

• You need to enter a card to start the trial.
• There is one free trial for each family and for each card. A card that has already had a trial does not get another: it is charged right away.
• The free trial includes a quarter of a month's usage for each learner; what it uses counts toward the month your plan starts in. At 100%, Albie pauses until your plan starts.
• When the trial ends, your plan starts and your card is charged, unless you have cancelled.
• You can also start your plan before the trial ends, from your dashboard: your card is charged that day, and the plan renews from then.
• Extra usage never applies during a free trial.

Renewal

Plans renew automatically, every month or every year, until you cancel. Each renewal is charged to the card on file.

Cancelling

You can cancel at any time under Plan and billing in your account, which opens Stripe's billing portal. Your plan then runs to the end of the period you have paid for, and does not renew.

Refunds

Payments are not refunded, for a monthly or a yearly plan, including for a period that is partly used. The exceptions are the first charge at a new price (see Taxes and price changes) and any refund the law requires. Questions about a charge: support@cadentic.ai.

If a payment fails

If your plan's first payment, when the free trial ends, doesn't go through, tutoring pauses until it does. If a later payment doesn't go through, tutoring can carry on while the payment is tried again, up to what your plan has already paid for, and pauses if it still fails. Updating your card under Plan and billing settles it.

Closing your account

A family, or a student with their own account, can delete the whole account under Delete this account in Account settings. This ends the plan at once, and time left on a period you have paid for is lost. A school's account is closed by writing to support@cadentic.ai.

Each plan includes an amount of tutoring every month, shared across the family. The dashboard shows how much has been used, as a percentage. Usage starts again on the 1st of each month, counted in Coordinated Universal Time (UTC).

At 100%, Albie pauses until the next month, unless extra usage has been turned on.

Tutoring is also limited to what your plan has paid for so far: if a payment is late or doesn't go through, Albie may pause until it is paid.

We may pause Albie on an account whose use is far beyond normal, and we will tell you if we do.

Extra usage

Extra usage is off until an admin of the account turns it on under Plan and billing and chooses a monthly limit for it. In a family the admin is a parent or guardian. On a student's own account it is the student, who needs a parent's or guardian's permission. With extra usage on, Albie keeps going past 100%, up to that limit, and you pay for what is used.

• Extra usage costs $3.75 per learner for each extra 10% of a month's usage.
• It is billed monthly, or sooner once unbilled extra usage reaches $50.
• It never applies during a free trial.
• You can switch it off at any time.

When you use Albie, do not:

• misuse Albie, or disrupt the service
• try to get around Albie's safety rules, or to get harmful content from Albie
• scrape Albie, or use it through automated tools
• resell Albie, or access to it
• upload other people's personal information

These rules apply to everyone who uses your account.

If the rules are broken

We may suspend an account that breaks these terms.

Albie is an AI, not a person, and Albie can be wrong.

• Albie's answers are for learning. They are not professional advice.
• Check important things with a teacher, or with another source you trust.

Honest schoolwork

Using Albie honestly for schoolwork is the family's responsibility.

Albie is not a crisis service or an emergency service. In an emergency, call 911 or your local emergency services.

When a child says something worrying, Albie may tell the adults on file for that child. Albie will not always notice, so please do not rely on this.

What you make

You and your children keep ownership of what you create with Albie, such as messages, drawings, uploads and code. You give us permission to store and process it, so that we can run Albie for you.

What we make

Cadentic, Inc. owns Albie's lesson materials and software.

Material from elsewhere

Lessons can include material from other sources, such as YouTube videos and pictures from Wikimedia Commons. That material stays under its own licenses, and is shown with credit.

YouTube videos are shown through YouTube's player. By watching them you also agree to YouTube's Terms of Service (youtube.com/t/terms).

Albie's voice is made with Kyutai's Pocket TTS speech model, used under its Creative Commons Attribution 4.0 license.

Albie is provided "as is". As far as the law allows:

• we do not promise that Albie will always be available, or that Albie's answers will always be right, and we make no other promises about Albie beyond the ones in these terms
• Cadentic, Inc. is not liable for losses that come from using Albie, or from not being able to use it

Nothing in these terms limits a right that the law does not allow to be limited.

These terms are governed by the laws of the US state named here, and disputes about them go to the courts in that state: Delaware.

We may change these terms. For a material change, we will email you at least 14 days, and not more than 30 days, before it takes effect.

The date at the top of this page says when this version took effect. We keep a record of the version you agreed to.

If you do not agree to a change, you can cancel your plan and delete your account before it takes effect.
